ACCEPTABLE USE POLICY This document sets forth the policy of Initech Computers with regard to the use of, access to, review and disclosure of various electronic communications and data, including those hosted, sent or received by Initech Computers clients, employees, consultants and subcontractors. This information systems policy applies to all individuals using Initech servers and network systems, including clients, employees, consultants and subcontractors. For the purposes of this document, "electronic communications" includes, but is not limited to, the hosting, the sending, receipt, and use of information through the corporate electronic information network, the Internet, voicemail, facsimiles, teleconferencing, and all other online information services. For the purposes of this document, "Initech Computers" and "Initech" constitute the same legal entity. For the purposes of this document, "users" constitute: clients, employees, consultants, subcontractors and anyone else utilizing any portion of Initech property. This document may be altered, updated and changed as needed. Initech will attempt to inform all clients, employees, consultants and subcontractors but has no responsibility for doing so or any user being unaware of the latest edition of this acceptable use policy. Monitoring, privacy and access Electronic communications, excluding hosted information and private communication, through Initech's information systems are the property of Initech to assist it in carrying out business. All users shall have no expectations of privacy with respect to any electronic communication. While Initech will not do this routinely, it reserves the right to monitor, access, review, copy, store or delete any electronic communications, including personal messages, from the system for any purpose and to disclose them to others, as deemed appropriate. Initech shall install access controls consistent with the requirements of all Initech policies. Data retention policy Initech will retain information as long as reasonably possible. Backups will be made at regular times but Initech does not take any responsibility for lost information. Prohibited activity and use of good judgment Use of electronic communications to engage in any communication or action that is threatening, discriminatory (based on language that can be viewed as harassing others based on race, creed, color, age, sex, physical characteristics, handicap, sexual orientation, or otherwise), defamatory slanderous, obscene or harassing is prohibited. Electronic communications shall not disclose personal information without authorization. The destruction or alteration of electronic communications with the intent to cause harm or injury to Initech, employees or consultants or subcontractors or clients of Initech is strictly prohibited. Electronic communications shall not be used for any illegal purposes or violate the intellectual property rights of others. Clients shall not break into Initech property or intercept communications of other individuals. Intellectual property and licensing Clients may not perform any actions that makes Initech a vehicle for the violation of any copyrights or licenses. Copyrighted information may not be used in electronic communications involving Initech without appropriate permissions. Clients may not remove intellectual property notices of others. Virus/Worm protection Clients, employees, subcontractors and consultants may not knowingly create, execute, forward or introdce any computer code designed to self-replicate, damage, or otherwise impede the performance of any computer's memory, storage, operating system, or software. It is a violation of this policy to disable any virus or worm checking facilities installed on any server or network. Responsibilities All users of Initech servers or electronic communications that takes place on, or passes through, Initech property shall be aware of this policy. Initech shall have the responsibility of testing access controls and the network for vulnerabilities. Users shall not test for vulnerabilities and access controls by manual or programmatic means. When vulnerabilities are known, users shall not exploit their effects by manual or programmatic means. When vulnerabilities are known, users are obligated to inform Initech employees about them and provide additional information if requested. The law Initech shall have the right to exercise their options under the appropriate criminal and civil laws to seek legal remedies from anyone who uses, abuses, or attacks Initech's network and information systems in a manner that would be in violation of the law and these policies. Disciplinary action Initech reserves the right to revoke any user's access priviliges at any time for violations of this policy and conduct that disrupts the normal operation of Initech's information systems or clients. Any conduct that adversely affects the ability of others to use Initech's servers and networks or which can harm or offend others, will not be permitted. Violations to this policy can result in any action up to and including termination of access and use without prior notice or legal action. Initech will no longer have any obligations to any clients, employees, subcontractors or consultants once this policy is breached. This includes the return of any stored information, the privacy of any stored information, providing any service or returning payments. Authority may be exercised without notice and Initech disclaims responsibility for any loss to data, software or income. Users whose association with Initech is terminated shall have their access privileges to Initech's resources and property immediately revoked.
